On June 3, 2022, the United States District Court for the Southern District of Illinois issued an opinion granting TDR’s motion to dismiss and dismissing a putative consumer fraud class action with prejudice. In the underlying lawsuit, the plaintiff alleged that numerous air conditioning models sold by TDR’s client contained a common design defect that caused the models to malfunction. As a result, the plaintiff claimed that TDR’s client engaged in unfair and deceptive business practices in violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, breached the implied warranty of merchantability, and was unjustly enriched.
